TERMS AND CONDITIONS OF SERVICE

1. Introduction
This document outlines the terms and conditions for the use of the private home medical service provided by The Health Guard S.r.l. - Società Tra Professionisti (hereinafter "Doc On Call"), with registered office at Viale Renato Parisano 50, 47921 Rimini, VAT no. 04750200406.
The service is available exclusively within the city of Rimini and operates 24/7, offering home medical consultations upon patient request.
This contract is governed by the provisions of the Italian Civil Code (Articles 1321 et seq. on contracts in general), the Italian Consumer Code (Legislative Decree 206/2005, with particular reference to distance service provisions), and all current laws regulating private healthcare services.
By accepting these terms and conditions, the patient agrees to comply with them and to use the service accordingly.
2. Booking Method
Appointments for home medical visits can be booked exclusively via telephone call.
The service is available only within the city of Rimini.
A booking is considered confirmed only after verbal confirmation by the operator.
Once confirmed, the booking cannot be canceled.
Pursuant to Article 59 of the Consumer Code, the right of withdrawal does not apply, as this is a personalized service requiring immediate execution and organization by the provider.
3. Payment and Cancellation Terms
Payment for the service must be made at the time of booking, via a payment link sent by email or WhatsApp.
Accepted payment methods: credit card or bank transfer.
Once the doctor has been assigned and is en route, the booking is no longer refundable, except in cases outlined under “Limitations of Liability”.
If the visit is canceled before confirmation and before the doctor has departed, the patient is entitled to a full refund.
According to Article 1464 of the Italian Civil Code, if the service becomes impossible to perform due to causes beyond the provider’s control, the party unable to fulfill the obligation is released from contractual responsibility.
4. Limitations of Liability
The home medical service does not replace emergency care and is intended only for non-urgent but deferrablemedical visits.
In case of medical emergencies, patients must call 118 or go to the nearest hospital.
If unforeseen events prevent the assigned doctor from attending the appointment, the patient will be contacted to:

Reschedule with another available doctor, or

Receive a full refund.
Doc On Call is not liable for any delays or service disruptions caused by external factors such as severe weather, traffic, or force majeure events (Article 1256 of the Italian Civil Code – Supervening impossibility).

Doc On Call commits to responding within 48 hours of receiving the complaint.
In case of disputes, the customer and Doc On Call will attempt an amicable resolution. If not possible, the matter may be escalated to the competent authorities, in accordance with Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 28/2010 on alternative dispute resolution (ADR and mandatory mediation for services).
6. Changes to Terms and Conditions
Doc On Call reserves the right to modify these Terms and Conditions at any time, in compliance with applicable regulations.
Any changes will be communicated via updates on the official website.
Continued use of the service by the customer implies automatic acceptance of the updated contractual conditions.
Should one or more clauses of these Terms and Conditions be deemed invalid or unenforceable, the remaining provisions shall remain fully effective, pursuant to Article 1419 of the Italian Civil Code.
Final Provisions
This agreement is governed by Italian law.
For any dispute relating to the interpretation or enforcement of these terms, the Court of Rimini shall have jurisdiction, unless otherwise required by mandatory provisions of the Consumer Code.
